1. Scope of this Agreement

2. These Subscription Terms of Service (“Terms”) supplement and form a part of our Account Terms of Service. Together with the Account Term of Service, these Terms form an agreement between you and Airtm. Any terms that are capitalised but not defined herein shall have the meaning given them in the Account Terms of Service. In case of any inconsistencies between these Terms and our Account Terms of Service, these Terms shall prevail.

3. References throughout the Terms to we/our/us are references to Airtm. Any references to User/you/your are references to you as a customer of Airtm and user of our services. 

4. These Terms set out the terms and conditions on which Airtm will provide Subscription Services to you. By signing these Terms, or otherwise proceeding or continuing to use the Subscription Services, you agree that you have read and understood, and that you accept, all of the terms and conditions contained in the Terms, and that an agreement (“Agreement”) exists between you and us based on these Terms. By signing the Terms, or otherwise proceeding or continuing to use the Subscription Services, you further agree that you have read, understood, and that you accept our Account Terms of Service.

5. The Agreement will govern your use of the Subscription Services provided by Airtm, as more fully described below.

6. We reserve the right to withdraw or amend access to the Subscription Services without notice.

2. Modification of Terms

We may, in our sole discretion, modify or update these Terms from time to time, and so you should review this page periodically. When we change these Terms in a material manner we will update the ‘last modified’ date at the top of this page. Your continued use of the Subscription Services after any update constitutes your acceptance of the modified Terms. If you do not agree to any of these Terms or any future modified Terms, you should discontinue use or access the Subscription Services; your sole and exclusive remedy is to terminate your use of the Subscription Services in accordance with Section 5. You agree that we shall not be liable to you or any third party for any modification or termination of the Subscription Services, or suspension or termination of your access to the Subscription Services, except to the extent otherwise expressly set forth herein.

3. Subscription Services

In consideration for the charges set out in Section 4 and payable by you, Airtm will provide the following services (the “Subscription Services”):

1. Transaction Fee Rebate 

All transaction fees paid to AirTM in connection with your AirTM account will be rebated on a monthly basis, up to a maximum of 15 (fifteen) USDC, provided however that fees or charges applicable to SEND transactions will not be rebated.

2. Additional Fee Rebates for Adds

After reaching the 15 USDC transaction fee rebate limit described in Section 3.1, you will be eligible to receive additional rebates with respect to “Add” transactions only. 

Additional rebates apply up to a maximum of an additional 10 USDC and include:

1. 20% rebate on any fees payable for add transactions completed on AirTM’s P2P platform.

2. 10% rebate for all add transactions completed using Payoneer Direct or when using an AirTM US virtual account.

3. 5% on all add transactions completed using PayPal methods 

    All additional fee rebates are subject to change.

3. Preferred card pricing 

4 (four) USDC rebate on Airtm’s prepaid ARS card (payable on a rebated basis to existing card holders also).

4. VIP Customer Service Experience 

All rebates will be made during the first Wednesday after the previous month ends. 

4. Subscription Charge

By subscribing to our Subscription Services you are agreeing to pay a recurring monthly fee of 10 (ten) USDC for an indefinite time until cancelled by you or us in accordance with Section 5. Such charges will be collected from your AirTM account on a monthly basis, specifically on the first Wednesday of each month.

5. Termination

   1. If you wish to cancel your monthly subscription, you must do so in the “Subscription Program” section of the platform prior to the cancellation date, which is the last day of the month. Failure to do so will result in the renewal of your subscription and application of the corresponding charge for the following month’s Subscription Services. Should you cancel after the payment has been processed, you will continue to receive Subscription Services for the following month, after which your subscription will be terminated.

   2. We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision. 

6. Usage Restrictions  

   1. The Subscription Services are available to existing Users only. The Subscription Services are currently only available to Users that are resident in Argentina and may only be used for personal, non-commercial use.

   2. You shall not (a) make the Subscription Services available to, or use the Subscription Services for the benefit of any other person (b) sell, resell, license, sublicense, distribute, rent or lease the Subscription Services, or otherwise make the Subscription Services available to any third party, (c) use the Service in a manner that violates Applicable Law or any applicable Third Party Application terms, (d) use the Service to store or transmit Malicious Code, (e) interfere with or disrupt the integrity or performance of the Service or third-party data contained therein, (f) attempt to gain unauthorized access to the Service or its related systems or networks, (g) permit direct or indirect access to or use of the Service in a way that circumvents a contractual usage limit, or bypass or breach any security device or protection.
