1. Organizer
These terms and conditions (the "Terms") govern the Airtm Loyalty Program (the "Program"), organized by Airtm Inc. ("Airtm" or "the Organizer"), located at 8 The Green, STE 300, Dover, DE 19901, United States.
2. Acceptance of the Terms
By participating in the Program, users acknowledge and agree to be bound by these Terms. Airtm reserves the right to modify these Terms at any time, and such modifications will be effective upon posting on the Airtm website or through other communication channels. Continued participation after any such changes constitutes acceptance of the revised Terms.
3. Program Description
The Program is designed to incentivize user engagement and retention on the Airtm platform through upfront savings, progressive rewards, and referral bonuses:
First Onboarding Transaction
New Airtm users who send a payment to the partners listed in section 4 will have 100% of the Airtm add funds fees covered for the preceding add funds transaction that generated those fees.
Progressive Fee Reduction
For the next five (5) transactions after the first eligible transaction, users will receive the following discounts on Airtm add funds fees:
- Second transaction: 20% discount
- Third transaction: 40% discount
- Fourth transaction: 60% discount
- Fifth transaction: 80% discount
- Sixth transaction: 100% discount (add funds with no Airtm fees)
Referral Program
Registered users can earn rewards by referring new eligible users to the platform:
- Referral bonus: For each referred user who verifies their Airtm account and completes at least four (4) add funds transactions of a minimum of $35 USDC each, the referring user will receive $2 USDC and the referred user will receive $1 USDC.
- Referral revenue share: Once the above conditions are met, the referring user will receive 5% of the revenue generated by the referred user's activity. This rises to 10% on the third transaction and 15% on the sixth. There is no limit on the number of users that can be referred.
The Program runs indefinitely or until the total budget of $25,000 USDC is consumed, whichever occurs first. Airtm may end the Program early if the budget limit is reached.
4. Eligibility
The Program is available to all registered Airtm users, subject to restrictions determined by Airtm. The participating partners are Deriv and Hapi. The maximum discount volume per transaction is capped at the fees generated on a maximum of $75 USDC per transaction, and applies only to Service Fees.
5. Accumulation and Application of Rewards
- First fee coverage: Applied 48 hours after the first add funds transaction.
- Progressive reduction: Discounts applied automatically on each eligible transaction.
- Referral bonus: Credited once the referred user meets the requirements.
- Referral revenue share: Calculated based on the referred user's activity and credited periodically (every Wednesday).
6. Limitations and Restrictions
- Airtm may set limits on the types or amounts of rewards.
- Program benefits are non-transferable and non-redeemable for cash, unless expressly stated.
- Airtm may disqualify users and withhold rewards if fraudulent or abusive activity is detected, or if these Terms are violated.
- The Program may be changed or terminated without prior notice.
- Users are responsible for paying any applicable taxes or charges on rewards.
7. Liability
- Airtm is not responsible for errors in recording or crediting rewards due to technical issues or user error.
- Airtm makes no warranties regarding the availability or accuracy of the Program.
- Participants agree to indemnify Airtm against any claims or expenses arising from their participation or violation of these Terms.
8. Data Privacy
By participating, users agree to the collection and processing of their personal information in accordance with Airtm's Privacy Policy.
9. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA. Any dispute will be resolved in the courts of Delaware, and participants accept this jurisdiction.
10. Organizer's Rights
Airtm reserves the right to:
- Modify, suspend, or terminate the Program at any time.
- Change the eligibility criteria.
- Adjust the reward structure.
- Interpret these Terms at its sole discretion.
- Monitor participation to ensure compliance and prevent fraudulent activity.
